HVLP Volunteer FAQ
Q: Do I have to take a case to volunteer?
A: Although the greatest need is for volunteer
attorneys to accept pro bono cases, HVLP also needs mentors,
interpreters, mediators and ad litems. Please let us know if you are
qualified to serve as a mediator or as an ad litem. Many HVLP cases
require ad litems; however, most applicants find it extremely difficult
to pay for ad litem fees.
Q: How can legal support staff contribute?
A: HVLP needs volunteer interpreters, legal assistants,
secretaries, graphic artists, photographers, notaries, court reporters,
and private process servers.
Q: How do applicants qualify?
A: To qualify for services, applicants must be
residents of Harris County and meet certain financial criteria based on
household income. Financial eligibility is confirmed by documentary
evidence such as pay stubs and tax returns.
Q: Does HVLP apply an assets test?
A: HVLP is required by it grants to review all
applicants' assets. The limit is $7,000 in liquid assets. Assets such as
homes and automobiles are recorded, but generally do not disqualify an
applicant.
Q: How are court costs and other additional fees
handled?
A: HVLP uses a formula based on the federal poverty
guidelines to determine financial eligibility. Applicant's whose income
falls under 125% of the poverty level may qualify for a pauper's
affidavit to waive filing fees and fees for service by constable.
Applicant's whose income exceeds 125% of the poverty level are required
to pay the filing fees to HVLP before the case is placed with an
attorney. HVLP will provide the volunteer with a check made payable to
the court for filing fees. All other costs, such as ad litem costs (if
necessary) are the responsibility of the applicant.
Q: Do I need to keep track of my fees and costs?
A: Yes. Regardless of whether a pauper's affidavit is
filed, HVLP's funding sources require us to report your fees and costs.
You need the same documentation in the event that a pauper's affidavit
is denied in whole or in part or if you try your case and need to prove
attorney's fees.
Q: Once I have met with a client, how do I notify HVLP
that I will accept or reject a case?
A: Enclosed in every referral packet is an Initial
Disposition form. After you interview an applicant, complete the form
and return a copy to HVLP.
Q: Do I need to use HVLP's Professional Services
Agreement?
A: Yes. Enclosed in the referral packet is an
engagement agreement. Please return a signed copy to HVLP.
Q: I need a mentor. Who should I call?
A: Call Marisa Flores, the Pro Bono Coordinator, at
(713) 228-0735, ext. 140, or email her at
marisa.flores@hvlp.org. She will provide you with an experienced
mentor who can advise you.
Q: Do I need to tell HVLP when the case is over?
A: Yes. Enclosed in every referral packet is a Final
Disposition form that should be completed and returned to HVLP. This
information is required by our funding sources. Please help our support
staff by returning these forms promptly after closing a case.
